Important Tips
Unless you have read and agreed to all the contents of this agreement, you have no right to use this service. If you purchase or use this service, it means that you have reached an agreement with EKEN Company and voluntarily accept all the contents of this agreement.
If you are under the age of 18, please use the service with the legal guardian or with the consent of the legal guardian; The minor’s exercise and performance of the rights and obligations under this Agreement shall be deemed to have been recognized by the legal guardian, and this Agreement shall be legally binding on you and your legal guardian.
Article 1:Service Description
1.1 This service is launched on the premise that you open the value-added payment service, based on your demand for automatic renewal, to avoid interrupting the service due to your failure to renew the service. Automatic renewal is divided into four types of subscription service periods: continuous monthly subscription, continuous quarterly subscription, continuous semi annual subscription and continuous annual subscription. The corresponding billing cycle fees are divided into monthly subscription fees, quarterly subscription fees, semi annual subscription fees and annual subscription fees.
1.2 If you subscribe to the service through Apple ID (“Apple” in this agreement refers to Apple Inc. and its affiliates) and do not voluntarily cancel the automatic renewal service 24 hours before the expiration of the next subscription service, Apple will automatically deduct the service charge for the next subscription period 24 hours before the expiration of each subscription period, from the balance of the Apple ID account (hereinafter collectively referred to as the “account”) bound when you open this automatic renewal service, so as to extend the service validity corresponding to this subscription period.
1.3 If you open the service through Android products and do not actively cancel the automatic renewal service within the subscription service period, the third-party payment channel will automatically withhold the fees for the next subscription service period from the balance of the google play payment account (hereinafter collectively referred to as the “account”) bound to you when you open the automatic renewal service from the day before the expiration of the payment service, so as to extend the validity of the payment service corresponding to the subscription period.
1.4 You understand and agree that the operator or payment channel will decide the deduction period according to the actual situation, and the deduction time of the above automatic renewal service is subject to the actual deduction time of each channel.
1.5 Please pay attention to the above various accounts and deductible balance. If the renewal fails due to account problems or insufficient balance, you will bear the risk or loss (if the corresponding rights and interests are terminated). If you do not take the initiative to explicitly choose to cancel this service, it will be deemed that you agree to EKEN’s deduction attempts from time to time within a certain period after the expiration of the subscription service (the specific deduction rules of each payment channel shall prevail). EKEN will continue to provide you with automatic renewal service when/after your account balance recovers enough. Once the deduction is successful, EKEN will continue to provide you with payment rights.
Article 2:Rules for Automatic Renewal
2.1 According to relevant laws and regulations, in order to let you know about the automatic renewal, the payment channel may send you a reminder notice before deduction. Please pay attention.
2.2 Please pay special attention to that, based on the characteristics of automatic renewal service, automatic withholding will be completed in the manner and time agreed in Article 1.2, 1.3 and 1.4 of this Agreement. If you do not explicitly cancel the automatic renewal service before withholding, EKEN will issue the withholding instruction for the next subscription period to the relevant subject according to your entrustment, and in principle, the fees deducted based on the instruction will not be refunded.
2.3 If there is an error in the fee deduction process, EKEN and you should closely cooperate to find out the cause and bear the losses caused by their own fault; If losses are caused by unequal faults of both parties, both parties shall bear corresponding liabilities according to the degree of fault; If both parties are jointly responsible, both parties shall share the responsibility equally.
2.4 EKEN Company will not charge you any additional fees for opening the automatic renewal service temporarily, but EKEN Company has the right to decide whether to charge additional fees for the automatic renewal service according to the needs of business development and publicize it to you on the relevant pages.
2.5 The service provided by EKEN Company to you is limited to your use in Aiwit App. Any use of paid services to evade renewal by malicious cracking or other illegal means constitutes a violation of this agreement. All legal consequences arising therefrom shall be borne by the actor, and EKEN will investigate the legal responsibility of the actor according to law.
Article 3:Suspension, Interruption and Termination of Services
3.1 Unless otherwise notified and announced by EKEN, this service will be effective for a long time. This agreement will come into force after you choose to accept or use this service, and will terminate when you terminate this service or cancel your paid service qualification.
3.2 In case of any of the following circumstances, EKEN has the right to immediately terminate the provision of services to you, and shall not be liable to you or any third party:
(1) It is confirmed by the effective legal documents of the national administrative or judicial authorities that you are in violation of the law or tort, or EKEN believes that your behavior is suspected of violating the contents of this agreement or the rules of use published by Aiwit from time to time, or is suspected of violating the provisions of laws and regulations according to its own judgment;
(2) Your behavior interferes with the normal operation of any part or function of Aiwit;
(3) EKEN believes that there are significant risks in providing this service to you.
3.3 EKEN may choose to suspend, interrupt and terminate the service according to its own business decisions and other reasons. If such situation occurs, EKEN Company will notify you in the form of announcement.
3.4 If you want to cancel the automatic renewal, you can cancel the automatic renewal 24 hours before the end of the next subscription period in the following ways:
(1) Apple ID purchase
iOS12 and above systems: Open the Apple iOS device “App Store” –>click the Apple account avatar in the upper right corner –>enter the “account” –>click “subscription” –>select “Aiwit” and cancel the subscription;
The following systems of iOS12: Open the iPhone “Settings” –>enter the “iTunes Store and App Store” –>click “Apple ID”, select “View Apple ID”, enter the “Account Settings” page, click “Subscribe”, select Aiwit, and cancel the subscription.
(2) Purchase of Android
Enter “Google Play” –>click the left sidebar –>”Subscription” –>”Manage automatic renewal”, select “Aiwit” and cancel the automatic renewal of subscription.
3.5 The successful cancellation of this service will not affect the effective service that you have successfully paid and deducted, and will not be automatically renewed after the expiration of the effective paid service. The instruction that you have entrusted EKEN Company to automatically renew and deduct fees before you choose to terminate the service is still valid. EKEN Company will not refund the fees deducted based on the instruction, and you shall bear the relevant responsibilities.
